QUESTION:

Are employees entitled to another bucket of Emergency Paid Sick Leave and Expanded Family Medical Leave under FFCRA in 2021?

ANSWER:

No, the employer’s obligation to provide FFCRA leave ended on December 31, 2020. However, the employer tax credit for those leaves has been extended through March 31, 2021.

The tax credit is available until March 31, 2021, for employers who voluntarily provide Emergency Paid Sick Leave and/or the Expanded Family Medical Leave to all their employees. The decision to provide the leave is entirely voluntary for the employer.   

Keep in mind, the extension of the tax credit until March 31, 2021, does not mean that a new bucket of time is available. If an employee has used all of the available FFCRA leave time in 2020, then they do not have any additional time under the tax credit extension in 2021. Stay tuned for more updates as DOL provides additional guidance.
