QUESTION: Do employers need to pay employees for getting the COVID-19 vaccination?

ANSWER: Currently, the COVID-19 vaccination is being made available to the public at no charge (though availability and supply are limited due to the phased rollouts that have been taking place in states across the country).  Employers who are requiring the vaccination should be prepared to subsidize this effort should costs unfold for whatever reason both as to out of pocket costs and conceivably the time it takes to get vaccinated as seeking medical attention at the direction of an employer during an employee’s working hours can be considered hours worked under the Fair Labor Standards Act (FLSA).
